According to Bernstein analysts, as reported by Cointelegraph, the prospect of the Digital Asset Market Clarity Act (CLARITY) failing to advance before the U.S. Senate begins its summer recess at week’s end poses a significant risk to cryptocurrency valuations. Should Congress not pass the legislation, traders are likely to respond with a sharp negative reaction, potentially driving another wave of selling pressure across Bitcoin and the broader crypto market.
Bernstein’s assessment suggests that while the near-term outlook appears challenging, stabilization could emerge in the latter portion of Q3 and into early Q4, possibly preceding mid-term electoral cycles. This near-term pessimism underscores how deeply cryptocurrency markets depend on regulatory clarity to sustain bull-market momentum.
SEC and CFTC Could Accelerate Alternative Framework
While legislative failure would clearly disappoint the crypto industry, Bernstein analysts observe that regulatory bodies may become more proactive in response. Such regulatory action, pursued through existing agency authority, could deliver meaningful guidance without awaiting Congressional action, potentially offsetting some market disappointment.

Investor confidence in CLARITY’s passage has deteriorated noticeably. On Polymarket, prediction market odds now stand at just 31% that the legislation will become law by the end of 2026—a decline of 7 percentage points over the past seven days and 9 points over the past month. The prediction market has attracted roughly $3.7 million in wagers, reflecting serious trader sentiment that legislative momentum has substantially eroded.
The crypto sector contends with opposition from banking organizations that object to specific CLARITY provisions. Banking groups contend that permitting cryptocurrency companies to offer stablecoin yields under regulatory treatment less stringent than that applied to conventional financial institutions creates competitive imbalances.
