The Securities and Exchange Commission and Commodity Futures Trading Commission jointly issued an interpretation in March that designated Bitcoin and comparable assets as digital commodities, thereby establishing a regulatory foundation independent of legislative intervention. SEC Chair Paul Atkins underscored this commitment recently, declaring that his agency is “ready, willing, and able” to develop rules that would address many of the same concerns the CLARITY Act was designed to resolve.

In a scenario where regulatory authority remains fragmented, the industry would have approximately two and a half years before a new presidential administration could potentially reshape the SEC’s leadership and priorities.
