New Memorandum Strengthens Regulatory Coordination

Hong Kong’s financial regulators have formalized an expanded partnership to oversee the digital asset sector. The Securities and Futures Commission (SFC) and the Accounting and Financial Reporting Council (AFRC) announced a new memorandum of understanding that extends their regulatory cooperation to encompass licensed virtual asset service providers. Beyond crypto businesses, the agreement also covers licensed financial corporations, registered open-ended investment funds, and authorized financial products.

The expanded framework creates comprehensive coordination mechanisms across multiple regulatory dimensions. The two agencies have committed to aligning on financial reporting standards, audit requirements, and compliance oversight for covered entities. Additionally, the memorandum establishes formal pathways for exchanging regulatory intelligence, referring cases between authorities, conducting joint field inspections, and coordinating investigations when necessary.

This agreement supersedes an earlier 2021 memorandum between the SFC and the Financial Reporting Council, the predecessor organization that underwent restructuring and renamed itself to the AFRC in 2022. The updated accord reflects evolving regulatory needs as Hong Kong’s digital asset sector has matured.
